Terms and Conditions

Publication Dates

The New York Sun publishes every morning, Monday through Friday, excluding holidays.

Circulation and Distribution

The New York Sun distributes approximately 100,000 copies of the paper on 4,500 newsstands. The single copy cost of the paper is $1.00 per copy. Home delivery is available for $3.75 per week. The distribution area of The New York Sun includes New York City (Manhattan, Brooklyn, Queens, Bronx, and Staten Island), Long Island (Nassau and Suffolk counties),Westchester County, southern Connecticut (Fairfield County), and northern New Jersey (Hudson, Passaic, Bergen, and Morris counties).

General Policy

All advertising accepted by The New York Sun is subject to all terms and conditions contained in this and subsequent rate cards and any insertion orders issued by The New York Sun, and by submitting advertising to The New York Sun you agree to be bound by all such terms and conditions. The New York Sun will not be bound by any conditions, disclaimers, or other terms, written or otherwise, appearing on any insertion order or contract of advertisers and/or agencies.

The New York Sun shall in no event be liable for failure to publish advertising specified by the advertiser and shall in no case be liable for any consequential incidental, indirect, or punitive damages.

The New York Sun reserves the right to decline advertising copy and to cease further publication of any advertising at any time, for any reason. Placement of advertising is at The New York Sun’s discretion. It is understood that in consideration of the publication of advertising, the advertiser and advertising agency will hold harmless and fully indemnify The New York Sun from and against any and all claims, demands, suits, and actions related to the publication of any advertisement.

Contract Advertisers

Contract advertisers are those advertisers and/or agencies who have contracted to place an agreed amount of advertising during a 12 month period via a New York Sun Advertiser/ Agency Contract Agreement form. These contracts must specify a definitive start date and are subject to the rate card effective when the contract begins. The contract is subject to subsequent rate card increases and modifications. Only the advertisements placed during the twelve month contract period will receive credit towards contract fulfillment. To receive a contract order form, please call 212-901-2700 ext. 2.

The contract advertisers and/or agencies agree to pay for advertising space as stipulated in the advertising agreement.

If an advertiser’s contract level is exceeded and the advertiser achieves the next contract level, the advertiser will be entitled to a rebate amount based on the retroactive application to the lower rate earned.

If an advertiser does not fulfill the agreed upon contract level, the advertiser will be assessed a shortage based upon the retroactive application of the higher rate earned. The advertiser and/or agency will be invoiced for the shortage.

Commission and Payment Terms

Advertisements must be paid for prior to publication deadline unless credit has been established for the advertiser and/or agency by The New York Sun.

Advertising agencies recognized by The New York Sun receive a commission of 15% of gross rates. Retail rates are net and not subject to commission.

Payment of invoices for advertisers on credit is due no later than the 15th of the month following the month in which the advertisement(s) run. Credit may be suspended without advance notice for accounts past due.
